Girl shot by Taliban to be reunited with family

Updated at 10:41 a.m. ET: The family of Malala Yousufzai, the 15-year-old Pakistani girl shot by the Taliban for speaking out for the right to an education, was on Thursday traveling to Britain to be reunited with her, NBC News has learned.

Meanwhile, Pakistan?s interior minister Rehman Malik announced that Yousufzai?was able to speak and had talked to her parents by telephone, The Associated Press reported.?

On Oct. 15, Yousufzai?was transferred to a hospital in the English?city of Birmingham to receive specialist treatment for the injuries she suffered earlier in the month.

Her father, mother and two younger brothers were due to arrive in the U.K. at 4:25 p.m. (11:25 a.m. ET), Pakistani and British sources told NBC News.

In a statement recorded for Pakistani state television, her father, Ziauddin Yousufzai, said his daughter would return home after her medical treatment, the AP reported. ?It was the first time he had spoken publicly since the Oct. 9 shooting in northwest Pakistan.

The teenage girl from Pakistan, Malala Yousafzai, who was injured by the Taliban in an attack, continues her recovery in a British hospital. NBC's Amna Nawaz has the latest.

In the statement, Ziauddin?Yousufzai dismissed rumors that his family would seek asylum overseas in light of continuing threats by the Taliban.

?I have seen doomsday and survived, you might say. Malala has been honored by the nation, by the world, by people of all classes of all creeds of all colors. I am grateful for that,"?Britain?s Daily Telegraph quoted Ziauddin?Yousufzai as saying?in an interview before he left Pakistan.?

A spokeswoman for the University Hospitals Birmingham said Yousufzai?was still comfortable and responding well to treatment at the city?s Queen Elizabeth Hospital.

Tributes and words of support from around the world continue to pour in to a special message board on the hospital?s website.

Malala Yousufzai remains in stable condition at Queen Elizabeth Hospital in Birmingham where she is receiving gifts, flowers and positive messages from around the world. Her family is expected to arrive in the UK in the next few days. NBC's Amna Nawaz reports.

Yousufzai began standing up to the Taliban when she was 11, when the Islamabad government had effectively ceded control of the Swat Valley, where she lives, to the militants.

The attack on Yousufzai and two other girls as they left school was the culmination of years of campaigning that had pitted her against one of Pakistan's most ruthless Taliban commanders, Maulana Fazlullah.

Answers sought as $3B Texas cancer agency meets

AUSTIN, Texas (AP) ? Texas put $3 billion on the table to prove it was serious about fighting cancer, but it will take more than money to convince scientists that's still the case.

Hundreds of the nation's top cancer researchers want answers and reassurance this week from the embattled Cancer Prevention and Research Institute of Texas, which is reeling after mass resignations and serious internal accusations that have put the nation's second-biggest pot of cancer research dollars in jeopardy.

The agency's annual conference begins Wednesday, with nearly 900 scientists and agency stakeholders expected to attend. Among the notables unlikely to show up: nearly three dozen renowned scientists, including a Nobel laureate, who severed ties with CPRIT this month over a controversial award.

Bill Gimson, the executive director of CPRIT since it was founded in 2007, is denying accusations that politics influence funding decisions as the agency hosts what is expected to be its largest annual conference yet. For three days, CPRIT officials will try to repair a once-celebrated image that was hailed as an unprecedented state-level effort to fight cancer.

"Obviously we will address issues that have surfaced," Gimson said. "I think, more importantly, we will reconfirm our commitment to a gold-standard peer review and picking the very best projects."

Thirty-three of the agency's scientific peer reviewers have recently resigned, many in protest. Nobel laureate Dr. Phillip Sharp, who headed the agency's scientific review council, wrote in a resignation letter this month that the agency is making funding decisions that carry a "suspicion of favoritism" in how the state hands out taxpayer dollars.

Others were more blunt: Dr. William Kaelin of Harvard Medical School, who also served on the council, accused the agency of "hucksterism."

The backlash stems from a $20 million commercialization grant awarded earlier this year for a so-called incubator project at M.D. Anderson Cancer Center in Houston. It was among the largest grants in the agency's young history and was approved without a scientific review, leading the agency's chief scientific officer to step down.

"If I could do that one grant over again, I would do it differently," said Gimson, adding that the agency has since examined its review process.

Gimson said the agency is still searching for a new chief scientific officer and doesn't believe the criticism coming from within the medical community will hamper efforts to replace those who've resigned.

Agency officials at this week's meeting also are scheduled to discuss ? but take no formal action on ? proposed changes to how the state divvies up grant awards between research, prevention and commercialization efforts to bring new drugs to market. The agency has awarded nearly $700 million in grants since 2009, mostly to fund research.

The keynote speaker Wednesday is Dr. Brian Druker, the celebrated oncologist who developed the groundbreaking cancer drug Gleevec.

The conference runs through Friday.

The Robert W. Galvin Center for Electricity Innovation will host World Bank Senior Energy Specialist Marcelino Madrigal, who will present ?Transmission Planning and Renewable Energy: Global Experience and Emerging Practices from the Developing and Developed World,? at 11:30 am on Friday, October 26 at the Galvin Center on the 16th floor of IIT Tower.

In their efforts to move toward a lower-carbon power sector, developed and developing countries are facing the need to considerably expand their transmission networks to serve the needs of renewable energy. The most cost effective renewable energy resources needed to decarbonize the electricity supply are usually located far from the existing transmission networks and consumption centers. Thus, transmission networks need be expanded and upgraded in order to reliably and cost-effectively connect and transport renewable energy supplies. Policy makers need be aware that renewable energy scale-up goes hand in hand with the expansion of transmission networks and that proper planning and regulatory actions are therefore necessary. The presentation will describe emerging approaches being undertaken by transmission utilities and regulators to cope with the challenge of expanding transmission for renewable energy scale-up. The challenge becomes surmountable if the conducive planning and regulatory approaches are implemented. Proactively planning and regulating transmission networks have been identified as key to ensure that transmission networks are expanded efficiently and effectively. New planning tools (methods) with certain features are greatly contributing to the overall effort to scale-up renewable interconnection. Linking planning with clear and stable cost recovery regulations is crucial. Based on the evolving experience and on established theory and practice, the report also proposes some principles to develop country-specific approaches to planning and regulation of transmission networks. The presentation will make an overview of some our work in various countries in different parts of the globe.

Marcelino Madrigal is a senior energy specialist at the World Bank?s Energy Anchor Unit.? He specialized in the technical and economic operations and planning of power systems and markets and associated regulatory aspects.? Prior to joining the Bank, he worked for four years the Inter-American Development Bank in the areas of electricity transmission, distribution, and regional energy (electricity and gas) integration and market design projects. Before that, he was with the Energy Regulatory Commission in Mexico as deputy general manager for research and regulatory development, and at the Energy Ministry as chief of staff for Electricity were he led different activities regarding electricity tariff regulation, renewable energy regulation, investment decision making, and electricity reform. He has extensively published in topics related to operations and planning of power systems and markets, and has delivered training in related fields to a number of electric utilities, regulators, and system operations in different countries. He was assistant professor at Morelia Institute of Technology national excellence research center in electrical engineering in Morelia, Mexico. He holds a B.Sc, M.Sc., and Ph.D degrees in electrical engineering all with emphasis in the technical and economic operations, planning, and design of power systems and markets. He has received several awards, among them, the Outstanding Young Power Engineering Award by the IEEE Power and Energy Society in 2006.

Nintendo profit outlook weakens ahead of Wii U launch

TOKYO (Reuters) - Nintendo Co Ltd trimmed its annual profit outlook Wednesday by almost one-half as a strong yen and diminished console sales weighed on earnings while it readies the launch of the successor to the hit Wii console, which it hopes will reboot earnings growth.

For the year to March 31, the creator of Super Mario lowered its operating profit forecast to 20 billion yen ($251 million)from a 35 billion yen forecast in July. That compares with a consensus estimate by 21 analysts surveyed by Thomson Reuters I/B/E/S of a 27 billion yen profit.

Its operating loss for the three months to September 30 edged down to 18.8 billion yen from a loss of 19.6 billion yen a year ago, and compared with an average loss forecast of 16 billion yen from four analysts.

Nintendo's Wii U, the successor to its 100 million-selling Wii machine, is slated to go on sale in the United States on November 18. The first hardware offering from Nintendo in six years boasts a tablet-like touch screen controller and a social network, and lets users record TV shows through TiVo and other digital recording services.

Yet, growing competition from tablet PCs and smartphones that are increasingly eating into the $78 billion gaming market mean the Japanese company, which began making playing cards more than a century ago, may struggle to repeat the hit it had with the Wii.

Its success or failure will also provide a clue to rivals Sony Corp and Microsoft Corp as to whether advanced games machines can hold back the challenge from mobile devices.

Nintendo said on Wednesday that it expects to sell 5.5 million Wii U machines by March 31, the first time it has released a sales target for the device.

The company lowered its full-year forecast for sales of its handheld 3DS by a million, to 17.5 million. Weak demand for the new 3DS, launched in February last year, forced Nintendo to slash the price of the new gadget by about one-third a year ago.

The company stuck with its forecast to sell 2.5 million DS handhelds for the 12 months.

Nintendo also revised its forecast for the euro-yen currency rate to 100 yen from 105 yen for the business year. It kept its forecast for a dollar-yen rate of 80 yen.

Since the start of the business year, Nintendo's shares have fallen 17 percent, compared with an 11 percent drop in Japan's benchmark Nikkei average. Its shares fell 1.7 percent to 10,290 yen on Wednesday before the company released its results for the quarter. The Nikkei fell 0.7 percent.

Amish children are twice as physically active as non-Amish children are, study finds

ScienceDaily (Oct. 23, 2012) ? Old Order Amish children are much more physically active and three times less likely to be overweight than non-Amish children, which may provide them with some long-term protection against developing Type 2 diabetes, University of Maryland School of Medicine researchers report in the journal Diabetes Care.

The researchers found that Amish children in Lancaster County, Pa., spent an additional 34 minutes a day in light physical activity, plus another 53 additional minutes a day in moderate to vigorous activity compared to non-Amish white children living nearby on Maryland's rural Eastern Shore. The amount of moderate to vigorous activity, which is important to cardiovascular health, was twice that of the non-Amish children. The level of physical activity was inversely correlated to their BMI, or body mass index, which is a measurement of body fat based on a person's height and weight.

"We know from our earlier research that Amish adults are just as overweight as non-Amish Americans of European origin, but they have half the incidence of Type 2 diabetes," says Soren Snitker, M.D., Ph.D., the study's senior author and an associate professor of medicine and pediatrics at the University of Maryland School of Medicine. "This study suggests that the Amish gain their excess weight relatively late in life, which may decrease their long-term risk of developing the disease." The number of years someone is obese is a risk factor for diabetes, irrespective of the person's age and current BMI.

Higher levels of physical activity and lower BMI are both protective against diabetes, Dr. Snitker says. Obesity is a major risk factor for Type 2 diabetes. Dr. Snitker says that while it is unrealistic to imagine that the general public will adopt the Amish lifestyle in its entirety, the study results underscore the need for parents to encourage their children to be more physically active. "We may be able to learn something from the attitudes of the Amish," he says. "Whether children are physically active or not depends a lot on choices their parents make. Do they facilitate physically demanding activities for their children or do they allow them to spend long hours playing electronic games or watching television?"

E. Albert Reece, M.D., Ph.D., M.B.A., vice president for medical affairs at the University of Maryland and the John Z. and Akiko K. Bowers Distinguished Professor and dean of the University of Maryland School of Medicine, says, "As America's children become increasingly overweight, they become more vulnerable to diseases such as Type 2 diabetes. The incidence of diabetes among our young people is rising at an alarming rate. This study by Dr. Snitker and his colleagues offers clear evidence of the benefits of exercise and maintaining a healthy body weight as reflected in the body mass index calculation."

The Old Order Amish in Lancaster County, Pa., trace their ancestry back 14 generations to a small group of Anabaptist Christians who came to Pennsylvania from Europe in the mid-1700s. They don't drive cars or have electricity in their homes and eschew many of the trappings of modern life.

The researchers compared data from 270 Old Order Amish children, ages 8 to 19, from Lancaster County and 229 children from Maryland's Eastern Shore. They measured the children's physical activity by having them wear a device to track their body movement, which allowed them to calculate how much energy they burned as a result of their activity.

Typical Amish children's activities include walking to school, playing with their friends, and performing chores.

"The Amish lifestyle affects the whole family, involving Old Order Amish (OOA) children in household or farming chores from an early age," the researchers note. "OOA children also seem to spend a substantial amount of time in outdoor play with their siblings and neighbors, facilitated by the large size of the OOA Amish nuclear family. OOA children do not use computers or electronic games, nor do they watch television. OOA children attend one-room school houses and almost always go outside for recess. Even the youngest OOA students use active transportation to get to school, generally walking in a group."

By comparison, non-Amish children "almost universally" travel to school and other destinations by bus or car, the researchers say.

The lead authors of the article are Kristen G. Hairston, M.D., M.P.H. and Julie D. Ducharme, M.D., who are both recent graduates of the fellowship program in endocrinology and metabolism at the University of Maryland School of Medicine.

The research was funded by grants from the National Institutes of Health (P30 DK072488, T32 AG000219, K01 AG2278), the Geriatric Research and Education Clinical Center at the Baltimore Veterans Administration Medical Center, the U.S. Centers for Disease Control and the American Diabetes Association (ADA). The journal Diabetes Care is an ADA publication.

The study is one of a number of studies conducted by University of Maryland School of Medicine researchers using data collected from the Old Order Amish in Pennsylvania. Alan R. Shuldiner, M.D., associate dean for personalized medicine and director of the Program in Personalized and Genomic Medicine at the School of Medicine, and a co-author of this study, operates an Amish research clinic in Lancaster Pa. Over the past 20 years, he and his research team have conducted more than a dozen studies with the Amish, looking for genes that may cause common diseases, such as diabetes, osteoporosis and cardiovascular disease.

HBT: Cano's 0-for-26 skid a postseason record

Robinson Cano has a way of making baseball look effortless. Which is all well and good when he?s batting his usual .310 with very good power. When he slumps, his usual manner makes him look lackadaisical and disinterested, even though he might be anything but.

Cano went hitless in a fifth straight game Sunday in the loss to the Tigers, and he?s now in an 0-for-26 skid that ranks as the longest hitless streak ever to be compiled in a single postseason, according to the Elias Sports Bureau.

The second baseman also made a key defensive miscue in the seventh inning today, mishandling the relay from short on what should have been an inning-ending double-play ball. Quintin Berry scored the Tigers? first run of the game on the play.

Overall, Cano is 2-for-32 for the postseason, though he does have four RBI.Raul Ibanez and Ichiro Suzuki, with five apiece, are the Yankees leaders.

What makes Cano?s struggles all the more incredible is that he finished the season on a remarkable 25-for-39 tear. He was so hot that even if one sticks the 2-for-32 onto the end of that, he still has a .380 average in his last 71 at-bats.

Given that Cano is the Yankees? best player, there?s not going to be any benching him. He?ll just have to hit his way out of the slump, something that figures to be pretty difficult with the Tigers throwing Justin Verlander and Max Scherzer the next two games. Cano has hit .226 with no homers in 31 at-bats against Verlander. He?s 2-for-11 with a homer against Scherzer.

ExactTarget Buys Pardot For $95.5M And iGoDigital For $21M As ...

ExactTarget, the marketing software giant that went public in March of this year, has picked up a pair of smaller companies to build out its portfolio: marketing automation company Pardot for $95.5 million?($85.5 million?in cash and?$10.0 million?in?ExactTarget?common stock) and analytics company iGoDigital for $21 million?($14.7 million?in cash and?$6.3 million?in?ExactTarget?common stock).

The two acquisitions will help ExactTarget compete better in a climate where its once-smaller rivals have been getting acquired by bigger fish, or gone public themselves. Those include Radian6 (now part of Salesforce), ?Aprimo, Inc. (now part of Teradata),?CheetahMail Inc. (part of Experian Group),?e-Dialog Inc. (a subsidiary of eBay Inc.), and the acquisitive Buddy Media; another competitor,?Eloqua, went public in August.

The Pardot exit represents another big win for Atlanta?s marketing/ad-tech startups. Earlier this year, the social media marketing company?Vitrue?went to?Oracle for $300 million, while publishers Gannett picked up social media marketers?Blinq Media?for $92 million.

Pardot, which has around 1,000 clients including companies like comScore, will help ExactTarget ? founded as an email marketing/automation company ? to build out the functionality it offers to sales and marketing teams. More specifically, it puts ExactTarget into a better position against the likes of Salesforce. Pardot?s software covers areas like CRM integration, email marketing, lead nurturing, lead scoring and ROI reporting for marketing and sales teams to work better together. It wraps these into a dashboard it calls LeadDeck.

In a letter sent to Pardot?s clients ? seen by TechCrunch and embedded below ? co-founder Adam Blitzer notes that the deal will mean ?better resources? for clients, but not higher prices or different terms, at least for current packages.

Meanwhile, the iGoDigital acquisition, although smaller, takes ExactTarget further into what it might offer its clients on the web.

Specifically, iGoDigital ? founded in 2004 in Indianapolis ? has developed solutions around the areas of e-commerce, recommendations and tracking site visitors to improve the buying experience. Clients of iGoDigital speak to how that technology gets used: they include Walmart, Amazon and Best Buy.

iGoDigital also offers predictive analytics services, an area that is still growing but becoming increasingly important as companies look to become more sophisticated in how they create content, sell products and in general do business online.

The idea behind buying iGoDigital is also to bring web-based marketing services closer together with the direct marketing that ExactTarget already offers. That underscores a trend for more convergence in how brands present themselves to consumers over the internet:

US: Hackers in Iran responsible for cyberattacks

U.S. authorities believe that Iranian-based hackers were responsible for cyberattacks that devastated Persian Gulf oil and gas companies, a former U.S. government official said. Just hours later, Defense Secretary Leon Panetta said the cyberthreat from Iran has grown, and he declared that the Pentagon is prepared to take action if America is threatened by a computer-based assault.?

The former official, who is familiar with the investigation, said U.S. authorities believe the cyberattacks were likely supported by the Tehran government and came in retaliation for the latest round of American sanctions against Iran.?

U.S.?officials told?NBC News recently?that they believe Iran, too, is behind the recent cyberattacks on U.S. banks.?Among the banks that have experienced massive distributed denial-of-service attacks have been JP Morgan Chase, Bank of America, US Bank, Regions Bank and Capital One. The attack is described to NBC News by one source, a former U.S. official familiar with the attacks, as being "significant and ongoing" and looking to cause "functional and significant damage."

NBC News also?confirmed last month that the Joint Chiefs of Staff's intelligence directorate, the J-2, warned of the threat in a highly classified Sept.?14 paper distributed among the intelligence community.

In the Joint Chiefs' paper, first reported by FreeBeacon.com, the joint?chiefs'?intelligence arm warned, "Iran's cyber aggression should be viewed as a component, alongside efforts like support for terrorism, to the larger covert war Tehran is waging against the West." Iran has steadfastly denied any involvement in the attacks.

Before Panetta's remarks on Thursday, U.S. officials had said nothing publicly about the Gulf attacks or the investigation. But Panetta described them in a speech to business leaders in New York City, saying they were probably the most destructive cyber assault the private sector has seen to date.?

Panetta did not directly link Iran to the Gulf attacks, but he said Tehran has "undertaken a concerted effort to use cyberspace to its advantage." And, he said the Pentagon has poured billions into beefing up its ability to identify the origin of a cyberattacks, block them and respond when needed.?

"Potential aggressors should be aware that the United States has the capacity to locate them and hold them accountable for actions that harm America or its interests," said Panetta in a speech to the Business Executives for National Security.

A current U.S. official acknowledged Thursday that the Obama administration knows who launched the cyberattacks against the Gulf companies and that it was a state actor.?

U.S. agencies have been assisting in the Gulf investigation and concluded that the level of resources needed to conduct the attack showed there was some degree of involvement by a nation state, said the former official. The officials spoke on condition of anonymity because the investigation is classified as secret.?

While Panetta chose his words carefully, one cybersecurity expert said the Pentagon chief's message to Iran in the speech was evident.?

"It's not something where people are throwing down the gauntlet, but I think Panetta comes pretty close to sending a clear warning (to Iran): We know who it was, maybe you want to think twice before you do it again," said cybersecurity expert James Lewis, who is with the Center for Strategic and International Studies. "I think the Iranians will put two and two together and realize he's sending them a message."?

He said Panetta's remarks were an important step by the U.S. because the Iranian cyberthreat "is a new dimension in 30 years of intermittent conflict with Iran for which we are ill-prepared. It's really important to put them on notice."?

The cyberattacks hit the Saudi Arabian state oil company Aramco and Qatari natural gas producer RasGas using a virus, known as Shamoon, which can spread through networked computers and ultimately wipes out files by overwriting them.?

Senior defense officials said the information was declassified so that Panetta could make the public remarks. The officials added that the Pentagon is particularly concerned about the growing Iranian cyber capabilities, as well as the often discussed threats from China and Russia. The two officials spoke on condition of anonymity because they were not authorized to discuss the cyberthreats publicly.?

In his speech, Panetta said the Shamoon virus replaced crucial system files at Aramco with the image of a burning U.S. flag, and also overwrote all data on the machine, rendering more than 30,000 computers useless and forcing them to be replaced. He said the Qatar attack was similar.?

One cyber security expert, contacted by NBC News, said the Shamoon virus was very significant in that it was able to retrieve intellectual property at the same time it disabled computers.

Panetta offered no new details on the Pentagon's growing cyber capabilities or the military rules of engagement the department is developing to guide its use of computer-based attacks when the U.S. is threatened.?

He said the department is investing more than $3 billion a year in cybersecurity to beef up its ability to defend against and counter cyberthreats, including investment in U.S. Cyber Command. And the Pentagon is honing its policies so that any actions comply with the law of armed conflict.?

"Our mission is to defend the nation. We defend. We deter. And if called upon, we take decisive action to protect our citizens," he said.?

He added, however, that the Defense Department will not monitor American citizen's personal computers, or provide for the day-to-day security of private or commercial networks.?

Panetta used the Persian Gulf attacks in his remarks as a warning to business community that it must embrace stalled legislation that would encourage companies to meet certain cybersecurity standards. And he is endorsing a planned move by President Barack Obama to use his executive powers to put some of those programs, including voluntary standards, in place until Congress acts.?

"These attacks mark a significant escalation of the cyber threat," Panetta said. "And they have renewed concerns about still more destructive scenarios that could unfold."?

U.S. authorities have repeatedly warned that foreign Internet hackers are probing U.S. critical infrastructure networks, including those that control utility plants, transportation systems and financial networks.?

"We know of specific instances where intruders have successfully gained access to these control systems," Panetta told the business group. "We also know that they are seeking to create advanced tools to attack these systems and cause panic and destruction, and even the loss of life."?

Business leaders, including the U.S. Chamber of Commerce, opposed the legislations, arguing it would expand the federal government's regulatory authority over companies already struggling in the tough economy. The bill also encourages more information sharing between the government and private companies.?

Panetta pressed the group to support the stronger cybersecurity measures, warning that failure to do so could have catastrophic consequences.?

"Before September 11, 2001 the warning signs were there. We weren't organized. We weren't ready. And we suffered terribly for that lack of attention," said Panetta. "We cannot let that happen again. This is a pre-9/11 moment."

While the U.S. has extensive cyber warfare tools of its own, analysts like Richard A. Clarke, former?counterterrorism chief in the Bush and Clinton White Houses, say the U.S. would find it very difficult to win a cyber war, because there is no country in the world with its level of vulnerability.?

NYC Soda Ban Sued By Businesses, Beverage Groups Including ...

NEW YORK -- Soda makers, restaurateurs and other businesses sued Friday to try to block the city's unprecedented move to restrict sales of super-sized, sugary drinks, an effort the city called a coup for public health but the industry views as unfair and undemocratic.

"For the first time, they're telling New Yorkers how much of certain safe and lawful beverages they can drink," said Caroline Starke, a spokeswoman for the business groups, whose complaint also faults the city for making the decision through an unelected board. The groups include the American Beverage Association, the National Restaurant Association, a soft drink workers union and groups representing interests ranging from movie theater owners to Korean-American grocers.

A spokesman for Mayor Michael Bloomberg, the regulation's chief champion, called the lawsuit a groundless effort to stop a groundbreaking policy.

"This predictable, yet baseless, lawsuit fortunately will help put an even greater spotlight on the obesity epidemic," said the spokesman, Marc LaVorgna, who noted that the city also won fights over outlawing smoking in bars and offices and forcing fast-food restaurants to list calorie counts on their menus.

The beverage industry hinted it was considering a suit as soon as the city Board of Health approved the regulation last month. The rule would stop restaurants, cafeterias and concession stands from selling soda and other high-calorie drinks in containers larger than 16 ounces. It's set to take effect in March.

Bloomberg has called it a reasonable way to fight an obesity problem that takes a toll on many New Yorkers' health and city hospitals' budgets.

The measure keeps people from drinking extra calories without thinking, he says. For someone who drinks a soda every day, for example, downing a 16-ounce Coke instead of a 20-ounce one trims 14,600 calories a year, or the equivalent of 70 Hershey bars.

"Nobody is banning anything," the mayor said when the plan passed, noting that someone who wanted a second soda could get one.

The soda makers and sellers say the city is being a nanny-like nag to consumers and imposing an unfair, uneven burden on businesses. Manufacturers will have to get new bottles, and eateries will lose sales to competitors that aren't covered by the rule, they say. A customer who couldn't buy a 20-ounce soda at a pizzeria would be able to get a Big Gulp at a 7-Eleven, for instance, as convenience stores are under different regulations.

"(The rule) unfairly harms small businesses at a time when we can ill afford it," the suit says.

It also says the Bloomberg-appointed health board shouldn't dictate the size of soft drinks. Ten City Council members signed onto a July measure calling on the health board not to approve the rule; a New York Times poll in August showed that six in 10 New Yorkers opposed it.

The city says the board, made up of physicians and other health experts, is exactly the panel to make such decisions. It has held sway over matters ranging from milk inspection in the 1870s to banning lead paint in 1960, the city notes.

V-Moda's been seriously edging for the audiophile crowd lately -- namely with its Crossfade M-80 on-ear headphones, the VAMP headphone amp for the iPhone 4/4S, and a soon-to-be disclosed followup dubbed as Vamp Versa. That brings us to its soon-to-be released M-100 headphones, which haven't really been a secret since their inception, making them a special set. Unlike many companies who strive for secrecy in regards to upcoming products, V-Moda's taken a drastically different approach with its latest cans, with owner Val Kolton stating that they're effectively the first crowd-sourced set of headphones.

Many headphone lovers out there likely know that Kolton's been heavily in contact with the Head-Fi community, hoping to craft the best sounding, looking and fitting ear-gear possible. As he puts it, "the easter egg and inside joke is that the [M-100 headphones] can actually stand up. It is the first headphone that we know of that 'stands above the rest' and all others fall down/crawl. It also can stand on top of a few other new brand's models almost like Cirque De Soleil." It may be hard to tell based on the fashion-focused looks, but the company is adiment that its audiogear goes through more stringent research and testing than some of the biggest names out there, and that it'll show in the end products. Most notably, its TrueHertz testing where, for the M-100, "six points from 5hZ to 12kHz are measured to be within [its] obsessive quality control levels." According to Kolton, most companies only check at 1Khz, and allow for much wider variances. He followed up stating that "like fine wine, a headphone is only as good as its fit (taste buds) and it's driver variances (grapes/cork). To us, all brands advertising 'HD' sound [aren't being forthright] unless they believe or even know these key components are "'fugazi.'"

For perspective, the M-100 is essentially the third iteration of the Crossfade LP over-ear headphones. Aside from a few tweaks to the design, it's packing an audiophile-focused tuning (rather than DJ) that's based on blending the voicings of its M-80 on-ears and the LP2 over-ears. It wouldn't be unfair to say the company is aiming for a flat, yet fun sound -- all in a package that's fit to take to the streets like its earlier offerings. Those familiar may know that just under 150 of the first 200 production-quality models are currently floating around as early stock and test units for a final bit of real-world feedback before mass-production begins -- and this editor's been lucky enough to get his mitts on a set for some initial impressions. The Global Arbitrage of Online Work - NYTimes.com

If you thought it has been tough to find good work over the last couple of years, just wait.

The old problem was a bad economy, the kind of thing that ends. Trends suggest that we?re heading for a global online arbitrage of opportunity, however, with good workers in bad places able to snatch business away from better-performing environments. If that happens in large numbers, the competition will get really fierce for everyone.

Recently two of the biggest online staffing companies, oDesk and Elance, have released surveys concerning the companies that hire workers over the Internet to do things like write software, and the mindset of online workers themselves.

Between them, oDesk and Elance claim to have more than four million coders, Web designers, marketing professionals and other workers. Some even spot porn on Facebook at a rate of four for a penny. In the second quarter of 2012, oDesk says, its contractors worked over 8.5 million hours, a 70 percent increase over a year earlier. The average freelancer at Elance, meantime, expects to make 43 percent more money in 2013, as more employers come online.

Taken together, the reports indicate a lot of growth ahead in the business, and a lot of talented people looking for work wherever they can find it. oDesk, which surveyed over 2,800 companies that used its service, found that 10 percent of these buyers were college students, and 58 percent described their companies as start-ups.

Not all those young companies will survive, but the habit of hiring online seems baked in; 64 percent of respondents said at least half of their workforce would be online by 2015, and 94 percent predicted that in 10 years most businesses would consist of online temps and physical full-time workers.

The range of jobs done online is increasing, too. Workers on Elance said the highest-growing job categories in 2013 would be Web programming, making mobile applications, design, marketing and content writing. oDesk respondents were heavily in those categories too, but also saw employment in customer service, secretarial work and high-level technology development.

?As we move along, we see an increase in all the categories of work,? said Gary Swart, the chief executive of oDesk. ?We now have lawyers, accountants, financial executives, even managers.? The only work unlikely to go online is immediate physical work, like plumbing, he said, adding, ?but even a plumber needs an accountant.?

What he doesn?t need, apparently, is an accountant anywhere nearby. Some 30 percent of the United States citizens working on oDesk are working for overseas companies, Mr. Swart said. An even greater number of overseas people are probably working for Americans, too. In interviews, both companies say the continuing economic troubles in Europe are driving more people to online employment. oDesk has seen a 78 percent growth in hours billed by companies in the United Kingdom this year, even though it has never had much of a presence there.

The online work is already changing how some governments think about labor. Last May the government of Bangladesh decided to classify online work as export-related commercial income, free of taxes, instead of as a taxed offshore remittance.

The idea, Mr. Swart said, is to foster the growth of online workers. In other words, if you?re reading this from one of the better parts of the global economy, it?s a good time to think about how to be indispensable.

Another interesting wrinkle from the oDesk survey: Education alone probably won?t help you get hired. Only 6 percent of the survey respondents rated schooling as a ?very important? reason to hire someone. It was the lowest-rated reason to hire someone. Work experience was first, followed by how other people rated the contractor, pay, portfolio of work, references, and scores on skills tests that oDesk offers online.

In the future, having a degree may be helpful, but having a reputation will be even better.

There are no promises that this will keep you from getting the common cold and sore throat. There is not even a promise that you won?t come down with a bout with the flu but eating healthy, using good hygiene, and taking your flu vaccine will go a long way in helping you to be ready for flu season this winter.

We?ve all experienced that sinking feeling you get when you look at an empty computer screen or a blank sheet of paper. Starting to write is the most difficult part of the process, and this is where formulas can help get you over that initial speed bump.

The first and easiest one is the interview. You can interview colleagues, clients, prospects or even yourself, if you?re so inclined. Here?s a clever idea you might want to consider.

Todd Black who?s in charge of business development for a large software firm in Silicon Valley, proposed writing a regular column entitled ?The Winner?s Profile?. It consisted of a short 300-word profile of leading executives in his industry. The benefits to Todd are numerous. It enables him to contact high profile prospects under a non-sales guise, which increases the likelihood of his call being returned. Who wouldn?t want to receive free publicity and ego fulfillment by being profiled in an article like this?

It was a great way to initiate a conversation, which ultimately turned into many productive business relationships. If the trade publication in your industry isn?t publishing such a ?winner?s profile?, suggest it. Smaller publications are often starving for articles and your suggestion is likely to be received extremely positively.

If you don?t have a prior endorsement from the trade publication, don?t let that stop you. You can write the article on ?spec?. That is you write the article first, and then seek places to get it published. This is how I typically work. You can pitch it this way when you call a high profile person in your industry that you want to interview.

?Hi. This Mark Satterfield and I?m in the process of preparing an article for submission to Our Industry Trade Journal on emerging trends and was hoping I could get 20 minutes of your time to interview you for the article.?

I ask for 20 minutes because it?s less demanding than asking for a half-hour but since hardly anyone actually schedules his or her time in 20-minute increments, you wind up getting at least a half-hour with the person.

Of course there is etiquette involved in this process. For example, you don?t want to conduct the interview and then never actually write the article. That will come back to haunt you. On the couple of occasions where I?ve written an article but haven?t found a place to publish it, I send a draft copy to the person I interviewed asking for their comments. Not only does this satisfy the individual?s curiosity about what you wrote, but it?s also another great excuse or reason to get back in contact with the person.

When the article does get published, I send everyone I interviewed a copy. This is a good idea to do even if you?re sure that they received a copy of the publication through other sources. It?s a nice professional touch, shows your consideration, and again it?s a great excuse to stay in contact!

The interview format is the easiest to write because you?re writing in the same style as you speak. Most people communicate just fine when they?re speaking. This conversational style also works very well when communicating on paper.

A test that one of my editors told me early in my writing career, is to read out loud what you?ve written. If it sounds like you speaking, it?s probably fine. Remember that in order to get published you?ve got to write. It?s been my experience that the interview format is the quickest way to get your next article produced.

Meshak Faton graduated from Vincennes University with a Bachelor's degree in Business Administration, Marketing and Pre-Law. ?After graduating from Vincennes Meshak was going to pursue a law degree however, he responded to an online advertisement for a Manager Training Position with Clearwater Communications, Incorporated. Meshak was offered and accepted the position. Shortly after beginning work at Clearwater Meshak was promoted into a Leadership role and on September 17, 2012 Meshak Faton was promoted to Management. "When I began work at Clearwater I did not realize how fast I was able to work my way through the Management Training Program. I have learned so many valuable lessons both personally and professionally and I am excited to continue my career." Meshak Faton will be promoted to Partner within the next few weeks upon completion of his management training.

What's Actually Inside an Oil Filter?

1. TAPPING PLATE


This serves as the entry and exit point for oil. Small holes around the edge facilitate the free flow of oil into the container. The threaded center hole is where the oil flows out and also how the container attaches to the engine.

2. ANTIDRAINBACK VALVE


Because the oil filter is typically located toward the middle or bottom of an engine, this rubber valve has a flap that blocks oil from draining back into the filter when the engine is off.

3. FILTER MEDIUM


The porous filter medium consists primarily of microscopic cellulose fibers along with synthetic fibers such as glass and polyester, which increase filtering efficiency and durability. The medium is also saturated with resin to give it strength and stiffness. Higher-grade filters have more synthetic fibers.

4. PLEATS


Folding the filter medium creates a greater total surface area. The number of pleats depends on the medium's thickness.

5. CENTER STEEL TUBE


The center tube provides structure and lets filtered oil return to the engine. The number, size, and position of the holes is key to ensuring that the oil flow is not restricted.

6. RELIEF VALVE


On a cold startup, oil can be too thick to filter. To prevent the engine from starving, the relief valve opens when the pressure builds enough to force the calibrated spring downward, allowing unfiltered oil into the center tube through the top.

7. END DISC


To keep unfiltered oil from leaking into the center tube, a fiber or metal end disc is bonded to each end of the filter medium. Some brands forgo discs and use a sealant to create solid ends.

8. RETAINER


A thin bit of metal that acts as a leaf spring, the retainer keeps the filter medium and end disc tight against the tapping plate.

(AP) ? The Boy Scouts of America plan to begin doing what critics argue they should have done decades ago ? bring suspected abusers named in the organization's so-called perversion files to the attention of police departments and sheriff's offices across the country.

The Scouts have, until now, argued they did all they could to prevent sex abuse within their ranks by spending a century tracking pedophiles and using those records to keep known sex offenders out of their organization. But a court-ordered release of the perversion files from 1965 to 1985, expected sometime in October, has prompted Scouts spokesman Deron Smith to say the organization will go back into the files and report any offenders who may have fallen through the cracks.

Smith said Mike Johnson, the group's youth protection director and a former police detective, will lead the review.

That could prompt a new round of criminal prosecutions for offenders who have so far escaped justice, said Clatsop County, Ore., District Attorney Josh Marquis. But investigations may require more than what most Scout files provide, including victims willing to cooperate.

"Let's even assume the suspect confessed," he said. "An uncorroborated confession is not sufficient for a conviction."

Many states have no statutes of limitations for children victimized when they were younger than 16, so even decades-old crimes could be fair game.

The Scouts began keeping the files shortly after their creation in 1910, when pedophilia was largely a crime dealt with privately ?not publicly. The organization argues that the files helped them track offenders and protect children. But some of the files released in 1991, detailing cases from 1971 to 1991, showed repeated instances of Scouts leaders failing to disclose sex abuse to authorities, even when they had a confession.

A lawsuit culminated in April 2010 with the jury ruling the BSA had failed to protect the plaintiff from a pedophile assistant Scoutmaster in the 1980s, even though that man had previously admitted molesting Scouts. The jury awarded $20 million to the plaintiff.

Files kept before 1971 remained secret, until a judge ruled ? and the Oregon Supreme Court agreed ? that they should be released. Attorneys are now redacting the addresses and other identifying material from the files, which stretch from 1965 to 1985.

The release means that alleged abusers, and the names of Scout leaders who failed to report them, will be made public soon in tens of thousands of pages of confidential documents __ one of the largest troves of the files the BSA has ever been forced to produce. A psychiatrist who reviewed the files, Dr. Jennifer Warren, found that police were involved in about two-thirds of the cases from 1965-1985.

Kelly Clark, a Portland attorney who won a landmark 2010 lawsuit against the Boy Scouts, says the documents show that even though the Scouts have been collecting the files nearly since the Boy Scouts' founding in 1910, the organization failed to use them to protect boys from pedophiles.

"What's significant is that the Boy Scouts could have these files for so long and not learn from them," Clark said.

Last week, the Scouts made public an internal report they compiled on the files by Warren, the psychiatrist who served as an expert witness for the Scouts in the 2010 Portland lawsuit. As part of the report, they emphasized the files' success in preventing pedophiles from entering Scouting ranks, but acknowledged the organization's failure to stop some abusers.

"In some instances we failed to defend Scouts from those who would do them harm," the Scouts said in a statement accompanying the report. "There have been instances where people misused their positions in Scouting to abuse children, and in certain cases, our response to these incidents and our efforts to protect youth were plainly insufficient, inappropriate, or wrong."

Warren's report found that, of 930 files created between January 1965 and June 1984, there were 1,622 victims. Of the total victims, at least 1,302 were involved in Scouting.

"My review of these files indicates that the reported rate of sexual abuse in Scouting has been very low," Warren wrote in the report.

Warren compared the rate of victimization in the Scouts ? about 1.4 to 2.1 youth per 100,000 ? to the nationally-reported incidence of child abuse by the U.S. Department of Health and Human Services, which found that in 1980, 70 per 100,000 children experience sexual exploitation each year.

Warren's analysis didn't account for the fact that files were destroyed for offenders who died or turned 75 years old, something she said didn't affect her overall conclusions.

Critics contend the organization's legal battles reflect a long-standing effort to protect the Boy Scouts' reputation, and to try to limit any lawsuits.

"It's a culture of denial and concealment," said Timothy Kosnoff, a Seattle attorney who in 2006 obtained documents on 5,200 alleged pedophiles who went into the files from 1949-2005.
